These Terms and Conditions govern your use of NoodleDesign.co and purchases made from Noodle Design, LLC (“Noodle Design,” “we,” “us,” or “our”).
By accessing this website, creating an account, placing an order, or purchasing a product, you agree to these Terms and Conditions. If you do not agree, please do not use the website or place an order.
Products and Team Stores
Noodle Design sells apparel, swimwear, swim caps, athletic equipment, accessories, customized merchandise, and other products through its general storefront and team- or program-specific storefronts.
Products displayed within a team store may be selected or approved for that particular team or program. Availability, pricing, customization options, required items, ordering windows, and fulfillment methods may vary by team, product, season, or vendor.
Unless expressly stated otherwise, Noodle Design is the seller of record for purchases completed through NoodleDesign.co. References to schools, clubs, teams, organizations, manufacturers, or brands do not imply that those organizations operate the Noodle Design website or process customer payments.
Product Information
We make reasonable efforts to provide accurate product descriptions, photographs, colors, sizing information, pricing, and availability.
Actual colors may vary due to display settings, manufacturing batches, materials, printing methods, embroidery, dye lots, or other production factors.
Sizing varies by manufacturer and product. Customers are responsible for reviewing applicable size charts and selecting the appropriate size before ordering.
If you are uncertain about sizing, please contact Noodle Design before placing your order.
Custom and Personalized Products
Many Noodle Design products are produced specifically for an individual customer, team, school, club, or organization.
Custom or personalized products may include, but are not limited to:
- Team-logo merchandise
- Printed or embroidered apparel
- Personalized swim caps
- Products containing a name, number, initials, or other personalization
- Made-to-order team merchandise
- Special-order colors, sizes, designs, or configurations
Custom and personalized products are final sale and cannot be returned or exchanged, except when the product is defective, damaged upon receipt, or Noodle Design made an error in fulfilling the approved order.
Customers are responsible for reviewing spelling, names, numbers, sizes, colors, artwork selections, and other personalization before submitting an order.
Orders and Order Acceptance
Submitting an order does not guarantee acceptance or fulfillment.
Noodle Design may cancel, decline, or modify an order when reasonably necessary, including because of:
- Product or inventory unavailability
- Pricing or website errors
- Suspected fraud or unauthorized payment activity
- Payment authorization problems
- Vendor discontinuation or supply limitations
- Production limitations
- Artwork, trademark, or licensing concerns
- Orders that cannot reasonably be fulfilled as submitted
If Noodle Design cancels an order after payment has been collected, the applicable amount will be refunded.
Pricing and Taxes
Prices are shown in U.S. dollars unless otherwise stated.
Applicable sales tax, shipping charges, customization charges, and other disclosed fees may be added during checkout.
We reserve the right to correct typographical, pricing, or product-information errors. If a material pricing error affects an order already placed, we may contact you before fulfillment and provide the option to proceed at the corrected price or cancel the affected item for a refund.
Payment
Payment is collected using the payment methods offered during checkout.
Third-party payment providers may process payment information on our behalf. Your use of those services may also be subject to the payment provider’s terms and privacy practices.
A successful payment authorization does not override these Terms, product restrictions, customization requirements, or our Return and Refund Policy.
Order Changes and Cancellations
Contact Noodle Design as quickly as possible if you need to request a change or cancellation.
We will make reasonable efforts to accommodate requests received before production begins, but changes and cancellations are not guaranteed.
Once a custom, personalized, printed, embroidered, manufactured, or special-order product enters production, the order generally cannot be changed or canceled.
Production and Delivery Estimates
Production and delivery times vary by product.
Many customized apparel products may require approximately 3–4 weeks. Certain specialty products, including custom swim caps, may require approximately 6–8 weeks.
These timeframes are estimates unless a product page or order confirmation expressly states otherwise.
Orders containing multiple products may be consolidated and shipped or delivered after all items are complete.
Vendor availability, carrier delays, seasonal demand, weather, production schedules, supply interruptions, and other circumstances outside Noodle Design’s reasonable control may affect fulfillment.
Shipping
Customers are responsible for providing an accurate and complete shipping address.
Noodle Design is not responsible for delays resulting from incorrect or incomplete addresses supplied by the customer.
If a package is returned because of an incorrect address, refusal, or failure to receive the shipment, additional shipping charges may apply before the order is reshipped.

Returns and Refunds
All returns, exchanges, refunds, damaged-item claims, and final-sale restrictions are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.
Intellectual Property
The Noodle Design website, Noodle Design branding, original graphics, photographs, written content, product presentations, and other materials owned by Noodle Design may not be copied, reproduced, distributed, modified, or commercially exploited without permission.
Third-party trademarks, team marks, school marks, manufacturer trademarks, and other intellectual property remain the property of their respective owners.
Team and Organization Artwork
Customers and organizations submitting names, logos, trademarks, designs, or other artwork represent that they have the necessary rights or authorization for Noodle Design to reproduce those materials for the requested products.
Noodle Design may decline work when authorization is unclear or when we reasonably believe use of submitted material may infringe another party’s rights.
Website Availability
We attempt to maintain reliable access to the website but do not guarantee uninterrupted or error-free availability.
We may modify, suspend, update, or discontinue portions of the website when reasonably necessary.
Prohibited Use
You may not use this website to:
- Engage in fraud or unlawful activity
- Attempt unauthorized access to the website or related systems
- Interfere with website security or operation
- Submit unlawful or infringing material
- Scrape or reproduce protected content for unauthorized commercial purposes
- Otherwise misuse the website or services
Disclaimer of Warranties
Except for warranties expressly provided by Noodle Design, manufacturer warranties, or rights that cannot legally be waived, products and website services are provided on an “as available” basis.
Nothing in these Terms eliminates consumer rights that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Noodle Design will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or purchase of products.
Where liability cannot legally be excluded, Noodle Design’s liability will be limited only to the extent permitted by applicable law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Noodle Design harmless from claims resulting from your unlawful use of the website, violation of these Terms, or submission of materials for which you do not possess appropriate authorization.
Governing Law
These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict-of-law principles.
Nothing in this section eliminates any consumer right or remedy that cannot legally be waived.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
Changes to These Terms
We may update these Terms as our business practices, website, services, or legal requirements change.
The Effective Date at the top of this page identifies the current version.
